Terms of Service

1. Introduction

Welcome to Banana Evolution ("Platform"), operated by Toonedy Developments. These Terms of Service ("Terms") govern your access to and use of the Banana Evolution website, user accounts, community services, gameplay systems, digital collectibles, marketplaces, referral programs, reward programs, early access features, and any related services made available by the Platform.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use Banana Evolution. Banana Evolution is currently in active development. Many features described throughout the Platform may still be in development, testing, or planned for future releases.

2. Definitions

For the purpose of these Terms:

• Platform means the Banana Evolution website, applications, game services, community services, marketplaces, and all related systems.
• Account means a registered Banana Evolution user account.
• User means anyone accessing or using the Platform.
• Banana Coins are the Platform's virtual in-game currency.
• Collectibles are digital items that may be earned, collected, traded, or otherwise obtained within the Platform.
• Marketplace refers to any Platform feature allowing users to exchange eligible digital items.
• Rewards means optional benefits, prizes, or incentives that may be offered through gameplay, competitions, referrals, community participation, or seasonal events.
• Season means a limited gameplay period that may include rankings, progression, rewards, or resets.

3. Eligibility

You must be at least 14 years old to create an account. If required by the laws of your country, users under the age of 18 must obtain permission from a parent or legal guardian before using the Platform.

Certain features—including reward programs, prize claims, referral rewards, and financial redemption systems—may only be available to users who are 18 years of age or older. Banana Evolution reserves the right to verify age where necessary.

4. User Accounts

Users are responsible for maintaining the security of their accounts. You agree to:

• provide accurate information;
• keep your login credentials secure;
• promptly notify us of unauthorized access;
• comply with these Terms while using the Platform.

You remain responsible for all activity that occurs through your account.

5. One Account Policy

Unless explicitly permitted by Banana Evolution, each individual may maintain only one personal account. Creating or operating multiple accounts to obtain gameplay advantages, rewards, referral benefits, or leaderboard positions is prohibited.

6. Platform Features

Banana Evolution may include features such as:

• gameplay
• seasonal progression
• leaderboards
• Banana Coins
• digital collectibles
• player marketplaces
• referral systems
• reward programs
• community events
• Discord integration
• Early Access programs

Not all features are currently available. Some features may be introduced, modified, delayed, or removed during development.

7. Development Status

Banana Evolution is currently in active development. As development progresses, we may:

• modify gameplay
• rebalance economies
• redesign mechanics
• reset progression
• adjust rewards
• remove features
• introduce new systems
• discontinue experimental content

These changes are a normal part of the development process.

8. Fair Play

Banana Evolution is built around fair competition. Users must compete honestly and respect the integrity of the Platform. Activities that interfere with fair competition may result in enforcement actions.

9. Prohibited Conduct

Users may not:

• use bots or automation
• use scripts or macros
• use auto-clickers
• exploit bugs
• manipulate leaderboards
• create fake referrals
• abuse reward systems
• operate multiple accounts
• impersonate another user
• share or sell accounts
• interfere with Platform security
• attempt unauthorized access
• distribute malicious software
• intentionally disrupt Platform services

Banana Evolution reserves the right to investigate suspicious behaviour.

10. Fair Play Monitoring

To maintain a fair competitive environment, Banana Evolution may use:

• automated detection systems
• server-side verification
• gameplay analysis
• fraud detection
• security monitoring
• manual review

These systems are designed solely to protect the integrity of the Platform.

11. Banana Coins

Banana Coins are a virtual in-game currency. Unless explicitly stated otherwise:

• they are not legal tender;
• they are not investments;
• they are not bank deposits;
• they do not represent ownership of real-world assets.

Banana Coins may only be used within the Banana Evolution ecosystem and in accordance with Platform rules. Future redemption features, where available, may be subject to eligibility requirements, verification procedures, regional restrictions, and additional program rules.

12. Digital Collectibles

Collectibles exist solely within the Platform ecosystem. Banana Evolution does not guarantee:

• future value
• market demand
• continued availability
• liquidity
• appreciation in value

Collectibles are intended for entertainment and gameplay purposes.

13. Marketplace

Where available, the Marketplace allows eligible users to exchange digital collectibles. Banana Evolution may:

• suspend listings
• remove fraudulent trades
• investigate abuse
• restrict Marketplace access
• reverse transactions where necessary to protect the Platform

Marketplace availability may vary by region or development stage.

14. Rewards

Banana Evolution may offer optional rewards through gameplay, competitions, leaderboards, referrals, community participation, seasonal events, and promotional campaigns. Rewards are never guaranteed. Eligibility may depend on:

• fair play compliance
• account verification
• age requirements
• regional availability
• successful fraud checks
• compliance with these Terms

15. Referral Program

Referral systems are intended to introduce genuine new users to the Platform. The following may result in removal of referral rewards:

• self-referrals
• fake accounts
• automated registrations
• misleading promotions
• abuse of referral systems

16. Early Access

Participation in Early Access provides users with the opportunity to test features before public release. Early Access content may contain:

• unfinished features
• bugs
• balancing changes
• temporary resets
• incomplete artwork
• experimental systems

Participation does not guarantee future rewards or continued access.

17. Intellectual Property

All intellectual property associated with Banana Evolution remains the exclusive property of Toonedy Developments. This includes:

• software
• code
• artwork
• characters
• user interface
• animations
• music
• logos
• branding
• game systems
• documentation
• digital assets

Users may not copy, reproduce, modify, distribute, or commercially exploit Platform content without written permission.

18. Account Suspension

Banana Evolution may temporarily or permanently restrict accounts where necessary to protect Platform security, investigate abuse, enforce fair play, prevent fraud, or comply with legal obligations. Enforcement actions may include:

• warnings
• temporary restrictions
• leaderboard removal
• reward removal
• account suspension
• permanent termination

19. Service Availability

Banana Evolution is provided on an "as available" basis. We do not guarantee uninterrupted availability. The Platform may experience maintenance, outages, updates, resets, and temporary interruptions.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Banana Evolution and Toonedy Developments are not liable for indirect or consequential damages arising from the use of the Platform. Nothing in these Terms limits any mandatory rights provided under applicable Dutch or European Union consumer protection laws.

21. Changes to These Terms

These Terms may be updated as Banana Evolution continues to evolve. Where appropriate, significant changes will be announced through the Platform. Continued use of Banana Evolution after updated Terms become effective constitutes acceptance of the revised Terms.

22. Governing Law

These Terms are governed by the laws of the Netherlands. Any mandatory consumer rights available under applicable local or European Union law remain unaffected.

24. Public Beta Notice

These Terms apply to the current development version of Banana Evolution. Before the official production launch, the Terms of Service will undergo professional legal review to ensure compliance with applicable laws and regulations.
